UTC provisions allowing modification of trust by beneficiaries cannot be used to remove trustee.
In Trust Under Agreement of Taylor, 164 A. 3d 1147 (Pa. 2017) the Supreme Court of Pennsylvania, reversing the intermediate appellate court, held that PA statute, modeled after the Uniform Trust Code (UTC), which provided for the modification of trusts by consent of the beneficiaries, could not be used to remove a trustee.
